第十五章 行政手續

第一條 一般規定

(一)旅客必須完全遵守有關始發地、經停地、目的地和飛越國家的法律、法規、命令、要求、旅行規定以及承運人的規章和要求,并承擔責任;

(二)天航對其雇員或代理人為了協助旅客取得必要的證件或簽證或遵守上述法律、法規、命令、要求、旅行規定等所提供的書面或其它形式的任何幫助或信息不承擔責任;對任何旅客因未能取得必要的證件或簽證或未能遵守上述法律、法規、命令、要求、旅行規定等而產生的后果,天航也不承擔責任。

第二條 旅行證件

(一)旅客應當出示有關國家法律、法規、命令或規定所要求的出境、過境、入境、健康和其它證件,應當允許天航收存其副本或復印件;

(二)旅客未能遵守適用法律、法規、命令、要求、規定或所持證件不完備,或者旅客不允許天航收存其證件副本或復印件,天航保留拒絕運輸的權利。

第三條 拒絕過入境

(一)由于旅客未獲準過境或進入目的地國家,天航按照有關國家的政府命令將旅客運回其始發地或其它地點時,該旅客應按天航規定支付其適用票價;

(二)用于運送至拒絕入境地點或遣返地的客票,天航不予辦理退款。

第四條 罰金、拘留費等

旅客對于因其未能遵守有關國家法律、法規、命令、要求、旅行規定或未能出示所要求的證件而造成天航支付或墊付的罰金、罰款或承擔的任何費用應當足額償還。

第五條 海關檢查

(一)海關或其他政府人員要求檢查其托運行李或非托運行李時,旅客應當到場接受檢查;

(二)由于旅客未能遵守上述規定,天航對旅客由此受到的損失或損壞不承擔責任。

第六條 安全檢查

旅客及其行李應當接受政府或機場行政人員或天航的任何安全檢查。

第七條 法律法規

天航因遵守有關國家法律、政府法規、指令、命令或規定,決定拒絕或已經拒絕對旅客提供運輸服務的不承擔責任。

 


 Article 15 Administrative Procedures

 

15.1 General

15.1.1 The passenger shall be solely responsible for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through and with Tianjin Airlines ’ Regulations and instructions.

15.1.2 Tianjin Airlines  shall not be liable for any aid or information given by any agent or employee of Tianjin Airlines  to any passenger in connection with obtaining necessary documents or visas or complying with such laws, regulations, orders, demands, and travel requirements, whether given in writing or otherwise; or for the consequences to any passenger resulting from his failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.

15.2 Travel Documents

15.2.1 The passenger shall present all exit, entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries concerned, and permit Tianjin Airlines to take and retain copies thereof.

15.2.2 Tianjin Airlines reserves the right to refuse carriage of any passenger who has not complied with applicable laws, regulations, orders, demands or requirements or whose documents do not appear to be in order, or who does not permit Tianjin Airlines to take and retain copies thereof.

15.3 Refusal of Entry

15.3.1 The passenger agrees to pay the applicable fare whenever Tianjin Airlines , on government order, is required to return a passenger to his point of origin or elsewhere owing to the passenger’s inadmissibility into a country, whether of transit or of destination.

15.3.2 The fare collected for carriage to the point of refusal of entry or deportation will not be refunded by Tianjin Airlines.

15.4 Fines, Detention Costs, etc.

If Tianjin Airlines is required to pay or deposit any fine or penalty or to incur any expenditure by reason of the passenger’s failure to comply with laws, regulations, orders, demands and travel requirements of the countries concerned or to produce the required documents, the passenger shall on demand reimburse Tianjin Airlines any amount so paid or deposited and any expenditure so incurred.

15.5 Customs Inspection

15.5.1 If required, the passenger should be present at the inspection of his/her baggage, checked or unchecked, by customs or other government officials.

15.5.2 Tianjin Airlines is not liable to the passenger for any loss or damage suffered by the passenger through failure to comply with the above-mentioned requirement.

15.6 Security Inspection

The passenger shall submit to any security checks by government or airport officials or by Tianjin Airlines.

15.7 Laws and Regulations

Tianjin Airlines is not liable if it determines that what it understands to be applicable law, government regulation, demand, order or requirement requires that it refuse and it does refuse to carry a passenger.
